police, for the alleged offence, under Sections 120(b), 406, 420, 468, 471, 294(b) & 506

(i) of IPC, in Crime No.14 of 2023, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused have promised the defacto complainant that they will secure a job in the Hindu Religious and Charitable Endowments Department and demanded a sum of Rs.40,00,000/-. Believing their words, the defacto complainant has paid the said amount to them. However, they have neither secured a job nor returned the money. Hence the case.

3.The learned counsel appearing for the petitioner submits that this petitioner has received a sum of Rs.8 Lakhs as a loan from the defacto complainant and he has returned the same to him. However, this amount has been projected as if this petitioner has received the said amount for the purpose of arranging job. The learned counsel further submits that the petitioner is no way connected with the alleged offence.

4.This Court, by earlier order, dated 20.08.2024, directed the petitioner to appear before the respondent police for interrogation. During the interrogation, the petitioner has stated that he has received a sum of Rs.4 Lakhs as a loan from the defacto complainant, by name, Chandrasekar and also returned the same to him and the amount was transferred through the Bank. any materials to prove that he has returned the amount to the defacto complainant.

During the enquiry by the Crime Branch, the petitioner has admitted that he has received a sum of Rs.28 Lakhs, out of which, he has returned only Rs.4 Lakhs and undertook to return the remaining amount of Rs.24 Lakhs within a stipulated time. He has also issued three cheques of Canara Bank bearing Nos. 385778, 385779 and 385780 to the defacto complainant. The issuance of cheques has been admitted by the petitioner, however, during the interrogation, he has stated that on compulsion, he has parted with the cheques. Though he claims that he has parted with cheques on compulsion, it appears that he has not lodged any compliant before the authorities for the same.

5.Considering the materials placed before this Court and the nature of

allegations as against this petitioner, this Court is not inclined to grant anticipatory bail to this petitioner.

6.Accordingly, this Criminal Original Petition is dismissed.
