Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.NILA, Advocate for the petitioner and of MR.R.GANDHI, Senior Counsel for M/S.GANDHI ASSOCIATGE, for the 1^st Respondent and MR.VEERANTHIRAN Government Advocate(Crl.side) on behalf of the Respondent No.2 the court made the following order:-

This Civil Miscellaneous Petition is filed by the Intervenor to cancel the anticipatory bail granted to the 1^st respondent in Crl.O.P(MD) No.7174 of 2024, vide order, dated 22.05.2024.

The contention of the Intervenor is that inspite of grievious injury anticipatory bail was granted without hearing him.

After hearing rival submissions of the Intervenor as well as the 1^st respondent herein/sole accused, this Court is of the consisdered opinion that if stringent condition is imposed that would suffice, instead of cancelling the anticipatory bail.

It is seen from the records that the alleged occurrence happened in Madurai. Therefore, the sole accused is directed to appear before the Inspector of Police, Srirangam Police Station, Trichy District, daily at 10.30 a.m. until further orders.

The Learned Government Advocate appearing for the respondent police submitted that the defact complainant has not submitted any written complaint. Therefore, the Defacto complainant/Intervenor is directed to file a

complaint before the respondent police. On such complainat, the respondent police is directed to conduct enquiry and as per law.
