Civil Miscellaneous Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to condone the delay of 865 days in filing petition to set aside the order dated 22.01.2019 dismissing the above Second Appeal as against the respondents 2 to 4 for nonpayment of batta.
PRAYER IN SA(MD)No. 87 of 2007:
To prefer this Memorandum of Grounds of Second Appeal against the judgment and Decree made in A.S.No. 133/2002 dated 07.07.2006 on the file of the Principal District Judge, Pudukottai reversing the judgment and decree made in O.S.No. 191/98 dated 07.03.2002 on the file of the Subordinate Judge, Pudukkottai.
ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.G.S.ASHOK ADHITHYAN, Advocate for the petitioner, the court made the following order:-
It is brought to the notice of this Court that C.M.P.(MD).No.5621 of 2021, was allowed with a condition to pay a sum of Rs.8,500/- as cost. But the above said condition was not complied. The above said order is modified to the effect that the amount is payable by the petitioner to the respondent, who is now appearing. The above said order must be complied on or before 10.12.2024.
