J U D G M E N T
This Civil Miscellaneous Appeal has been filed by the appellant as against the order passed in M.C.O.P.No.25 of 2008, dated 30.09.2008, on the file of the I Additional Motor Vehicle Accident Claims Tribunal, Nagercoil.
2. When the matter is taken up for hearing, the learned counsel appearing for the appellant represented that already the Insurance Company preferred the appeal in C.M.A(MD) No.166 of 2009 and the same was settled before the Lok Adalat and the amount was paid by the Insurance Company. This appeal also preferred against the same order, since the trial Court has passed an award that the appellant herein and the appellant in C.M.A.(MD) No.166 of 2009 are jointly and severally liable to pay compensation amount, and the matter has been settled between the parties and the Insurance Company had deposited the entire amount. Hence, nothing survives for further adjudication in the Civil Miscellaneous Appeal.
