This application has been filed to permit the agent of the

applicant to withdraw a sum of Rs.58,73,450/- which has been deposited in Arb.Appln.No.356 of 2024 in A.No.231 of 2020.

I have gone through the affidavit filed in support of the

application and also heard the learned counsel for the applicant. I have 3/6

also gone through the Agency agreement dated 22.11.2018 between the

¶54

petitioner and the Taurus Shipping Private Limited.

It is seen that the said Taurus Shipping Private Limited has

been empowered to represent the applicant and during subsistence of this agreement, the agent shall render the full range of customary Port agency services to the Principal, including collection of receivables accruing in India for / on behalf of the Principal and all collections are to be properly accounted for by the agent.

In view of the above, I do not find any legal impediment

¶58

to permit the agent to receive the payment out from the Registry.

Accordingly, this application is allowed.
