This Court, by its order dated 21.11.2023 directed the respondent/ defendant to furnish security to the extent of the suit claim, i.e. Rs.1,27,50,000/- on or before 20.12.2023.

2.On the last date of hearing, the learned counsel for the respondent/

defendant submits that an application seeking for leave to defend the suit has been filed.

3.Registry has now submitted a report stating that no such application has been filed by the respondent/defendant.

4.Till date, the respondent/ defendant has not furnished security as directed by this Court in its order dated 21.11.2023. It was made clear on the last hearing date i.e. 01.03.2024 that if no part payments were made by the respondent/defendant on or before the next hearing date, this Court will be constrained to order attachment of the property as prayed for in this application. Till date, security has not been furnished by the respondent/ defendant as directed by this Court in its order dated 21.11.2023.

5.Therefore, this Court orders attachment of the property morefully described in the schedule to the judges summons in this application and this application is allowed as prayed for.
