This application has been filed to condone the delay of 75 days in re-presenting the above suit.

- Heard both sides and perused the materials available on record.

- The learned counsel appearing for the respondent/defendant has no serious objection for allowing this application.

- Though this Court is not satisfied with the reasons stated in the affidavit filed in support of this application, however, in order to give an opportunity to the applicant/plaintiff to raise his defence, the delay is condoned.

5. Accordingly, this application is allowed.
