By this application, the applicant seeks permission to effect substituted service by publication on the first respondent. The applicant filed an affidavit of service stating that private notice could not be served on the first respondent because such notice was returned with the endorsement "no such person". Court notice was also returned unserved with the endorsement that the first respondent does not reside at the address specified in the notice. Upon being directed to ascertain the current address of the first respondent, learned counsel submitted that the first respondent had not communicated a change of address to the Trade Marks Registry and that the petitioner was unable to identify an alternative address. In these circumstances, this application is liable to be and is hereby allowed by permitting the applicant to effect substituted service by
