Since the property comprised in the Sale Deed dated 16.07.1941 registered as document No.2234 dated 22.07.1941 has been purchased after the partition in their joint names, only this property is available for partition and the plaintiffs would be entitled to a 1/3rd share to the same. The documents filed on the side of the defendants would clearly show that the each of the sharers have been enjoying their shares exclusively. Exs.B10 to B30 would clearly prove the above facts. The Courts below have failed to appreciate that under Ex.A11-Sale Deed, property has been purchased jointly by Krishna Reddiar, Varadha Reddiar and Kesava Reddiar and this property, which jointly stands in the name of three, has to be partitioned. Therefore, both the Courts below have elaborately considered the evidence, discussed the same and arrived at their conclusion in respect of the other properties and no exception can be taken to the same. Therefore, the substantial question of law is answered against the plaintiffs. However, the suit is partly answered against the plaintiffs. They are only entitled to a 1/3rd share in the property that is comprised in Ex.A11-Sale Deed. Therefore, the second appeal is
