The second respondent has stated in paragraph 30 of their
common counter affidavit as follows :
“30. I state that in respect of averments at Para No.28 of the common affidavit filed by the applicant / plaintiff is denied in toto. It is submitted that Defendant's Serial “Mast Mauli” after completion of 90 episodes was unilaterally stopped by the Channel the first respondent/ Defendant No.1 and is currently off air which has subjected the second respondent / Defendant No.2 to unnecessary hardship and financial losses. I therefore state that O.A.No.246 of 2023 injunction application has become infructuous.”
