PRAYER:- This Civil Revision Petition has been filed under Article 227 of the Constitution of India, to set aside the fair and decretal order dated 15.03.2023 passed in I.A. No.1 of 2019 in O.S. No. 46 of 2019 on the file of District Munsif Court, Rajapalayam and allow the present Civil Revision Petition.

This Civil Revision Petition has been filed by the petitioners to set aside the fair and decretal passed by the District Munsif Court, Rajapalayam order in I.A. No.1 of 2019 in O.S. No. 46 of 2019 dated 15.03.2023.

2.The petitioners are aggrieved by the impugned order dated 15.03.2023 passed by the District Munsif Court, Rajapalayam, in I.A.No.1 of 2019 in O.S.No.46 of 2019.

3.By the impugned order, the Trial Court has dismissed the application with the following observations:-

4.The petitioners are the plaintiffs in O.S.No.46 of 2019 before the

District Munsif Court, Rajapalayam. The suit was filed for a declaration and for a permanent injunction in respect of the suit schedule property. The Court had suo-motu appointed as Advocate Commissioner to give a report. Pursuant to which, a report was filed on 18.03.2017. After the trial was completed, the petitioners filed I.A.No.1 of 2019 for reissue a warrant to the same Advocate Commissioner for measuring the property. The said application was dismissed by the Trial Court.

5.In my view, the impugned order does not suffer from any infirmity.

There was no justification in filing I.A.No.1 of 2019 at the stage of final hearing of the case. Therefore, this Civil Revision Petition is liable to be dismissed. However, it is left open to the petitioners to file objection to the report of the Advocate Commissioner filed on 18.03.2017 before the Trial Court. Considering the suit is of the year 2019, the District Munsif Court, Rajapalayam, is directed to dispose O.S.No.46 of 2019 as expeditiously as possible.
