The petitioners in Crl.O.P.No.9530 of 2023 arrayed as A.4 & A.10 and the petitioners in Crl.OP No.9533 of 2023 arrayed as A.8 & A.9, relative of A.4, apprehend arrest at the hands of the respondent Police in the case in Crime No.1 of 2023 that was registered by the respondent police based on the complaint lodged by one Mrs.K.Megala, seeks anticipatory bail.

The defacto complainant has lodged a complaint with District Crime Branch, Tiruvannamalai, based on which the respondent police had originally registered the case in Crime No.11 of 2022 on 11.12.2022 for the alleged offence under Section 420 of IPC and arraying one Mr.Samsumaidheen as a sole accused in the said case.

had then registered the case on 27.02.2023 in Crime No.1 of 2023 for the alleged offences under Sctions 120B, 406, 420 r/w Section 34 of IPC,

Section 5 of TNPID Act, 1997, Section 21 (3), 23, 25 of The Banning of Unregulated deposit schemes Act 2019 and Section 76 of The Chit Funds Act, 1982, arraying the petitioners and the other accused in the case.

The case of prosecution is that defacto complainant Megala has alleged that the accused who was running a chit fund in the name of CVRS Chit Funds Pvt. Ltd., at Cheyyar had induced her and several other persons numbering 22 people, received deposits from them, cheated to the tune of Rs.50 Crores and hence the complaint. According to the prosecution, the petitioners are arrayed as parties on the footing that they have also formed part of the transfer and some of the properties have been purchased in their name out of the amount deposited and collected from the depositors.

The learned counsel for the petitioners submitted that they have no role to play and the co-accused A.10 has been granted bail in Crl.O.P.No.8354 of 2023 on 19.04.2023 and another accused has also been granted bail on 05.05.2023 in Crl.O.P.No.10256 of 2023 and seeks anticipatory bail.

The investigation officer has filed status report. As per the status report, A.1, A.2 & A.3 are companies while A.5 is wife of A.4, A.8 is brother-in-law of A.4 and A.9 is wife of A.8. Father and mother are other two persons namely the petitioners herein. The case of the prosecution in brief is that a chit has been promoted by the petitioners which is run by these accused. The company will reimburse the amounts in two folds apart from gifting of silver articles, gold and grocery items to the investors at large on the eve of celebrating Diwali and Pongal in delighted manner, if they deposit either monthly instalment or one-time payment of Rs.500/- to Rs.50,000/- in CVRS Chits Private Limited. However, they have not returned the amount as on date and 483 complaints have been received in respect of nonreimbursement of matured amount to the depositors and as on date the amount swindled by the accused run into Rs.49 Crores, documents that have been identified so far runs into 15 properties.

Considering the nature and gravity of the offence and also the specific overtact alleged against the petitioners herein in actually involving themselves in furtherance for the chit scheme for Pongal and Diwali and non-

reimbursement of the matured amount, I am not inclined to grant anticipatory

bail to the petitioners.

Accordingly, this Criminal Original Petition is dismissed.
