To prefer this memorandum of grounds of Second Appeal against the judgment and decree dated 29.08.2006 made in A.S.No. 177 of 2003 on the file of the District Judge, Kanniyakumari at Nagercoil confirming the Judgment and Decree dated 10.01.2003 made in O.S.No 67 of 1992 on the file of the Court of the 1st Additional Subordinate Judge, Nagercoil.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.JAYAKUMAR, Advocate for the petitioner, the court made the following order:-
When the matter was taken up for hearing on 27.01.2023, there was no representation for the petitioner. In order to give an opportunity to the petitioner, the matter was directed to be posted today i.e. 31.01.2023 under the caption 'for dismissal'. Even today there is no representation for the petitioner. Hence, these Civil Miscellaneous Petitions are dismissed 'for default'.
