This petition has been filed to return Ex. A1, dated 23.08.2004 filed in O.S.No.313 of 2011 on the file of the II Additional District Munsif Court, Kuzhithurai to the petitioner/appellant.

The learned counsel for the petitioner would submit that the petitioner herein has decided to execute a registered settlement deed in favour of her daughter. For that purpose, the original settlement deed is required. Hence, he filed this petition for return of Ex.A1, dated 23.08.2004.

When the matter came up for hearing on 24.07.2023, this Court has recorded that there is no representation on behalf of the respondent and directed to post the matter under the “caption for orders” on 27.07.2023.

Today also, in respect of the respondent, there is no representation.

Hence, having considered the submission of the learned counsel for the

petitioner and the averments made in the affidavit, this Court is inclined to allow this petition.

In the result, this petition is allowed and the Registry is directed to return the
