When the matter was taken up for hearing, learned counsel for the Appellant sought permission of this Court to withdraw this Civil Miscellaneous Appeal and sought permission of this Court to withdraw the claim amount from the bank. An Endorsement to the said effect is also made by the learned counsel for the Appellant in the Appeal today.

In view of the above, this Civil Miscellaneous Appeal stands dismissed as withdrawn with a liberty to the appellant to withdraw the claim amount, if there is no legal impediment. No costs.
