The petitioner is a non-minority aided school, the AIDED Primary School, Srirangarajapuram, established in 1938. It challenges an order of appointment of the 7^th respondent as Nutrition Food Scheme Helper to the School in preference over the 6^th respondent, who has been recommended by the Committee.

2.The petitioner relies in this regard on G.O.Ms.No.4, Social Welfare & Nutritious Meal Programme (Noon Meal-II) Department, dated 06.01.2011, which sets out the basis of appointment for Noon-Meal Scheme Helpers in both minority as well as non-minority schools. The relevant portion of the GO is extracted below:

3.While reliance is placed by the petitioner on the first portion of the aforesaid government order, that provides for the setting up a committee to make recommendations for appointments, such recommendation to be taken note in effecting the appointments, my attention is drawn by learned Additional Government Pleader to the second portion of the GO that deals with the methodology to be followed in effecting appointments in non-minority schools, of which, the petitioner is one.

4.In such an event, the procedure set out is wholly different, in line with G.O.Ms.No.163, Social Welfare & Nutritious Meal Programme (Noon Meal-II) Department, dated 18.08.2010 and G.O.Ms.No.142, Social Welfare & Nutritious Meal Programme (Noon Meal-II) Department, dated 06.07.2010. There is no requirement in the second situation for the constitution of a committee or for its recommendation to be forwarded or be taken note of in effecting appointments.

5.G.O.Ms.No.4 dated 06.01.2011 was itself the subject matter of challenge in a batch of writ petitions. Though quashed by a learned Single Judge, a Division Bench of this court in W.A.(MD) Nos.107 of 2013 and batch have upheld the validity of the government order, as a result that that the difference in procedure adopted for appointment of noon meal workers in minority schools and aided nonminority schools stands confirmed.

by the School committee is thus not relevant in the matter of appointments in non-minority aided primary schools and the impugned order is thus sustained. This Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
