The Writ petitioner while working as Commercial Inspector at AE/O & M, Aavalurpettai, one Mr.Perichigounder had made an application for a new Electricity connection for his agricultural Well Pumpset service connection. The defacto complainant P.Prakasam, S/o Perichigounder visited the petitioner's office and enquired about the service connection, the petitioner informed the defacto complainant to produce relevant records to prove the land comes under Survey No.41/1 which was subsequently, changed to 41/1B. On 7.3.2011, a trap was laid by the Directorate of Vigilance and Anti Corruption based on the complaint given by P.Prakasam that the petitioner demanded bribe for providing new electricity service connection to his agriculture Pumpset. The defacto complainant had approached the petitioner in his office and during the course of conversation between the petitioner and the defacto complainant, the officials of the DVAC arrested the petitioner alleging that the petitioner demanded bribe from P.Prakasam and remanded to judicial custody. Thereafter, a criminal case has been registered in Cr.No.3 of 2011 for the offence punishable under Sec.7 of Prevention of Corruption Act, 1988 and the case was taken on the file of Special Court constituted to try the cases under Prevention of Corruption Act, Villupuram in Spl. C.C. No.17 of 2014. According to the petitioner, examination of witnesses has already been concluded and the case was posted for arguments. The petitioner was placed under prolonged suspension for more than 12 years. Therefore the petitioner has approached this Court for revocation of suspension order.
