23 cents situated at Arumbavur Village for manufacturing and baking of mud pots, however, as their possession over the same was disturbed by third parties, the petitioner community members have filed a suit in O.S.No.115 of 1986 on the file of the District Munsif Court, Perambalur as against the 3rd respondent, for declaration of title and permanent mandatory injunction to safeguard their possession over the subject property and the same was decreed in their favour on 09.01.1989 based on the joint endorsement. Pursuant to the said decree, the petitioner community people are in absolute possession and enjoyment of the same. Whileso, on 03.03.2016, the 2nd respondent along with staffs of the local Panchayat and police personnel came to the subject property and removed the pots manufactured by the petitioner community people and upon enquiry, the petitioner/association came to know that, the 1st respondent, vide proceedings bearing No.R.C.A1/7263/2015 dated 30.10.2015, reclassified the subject land as "Government Poromboke (Natham)" and decided to utilise the same for the purpose of construction of Anganvadi building, as the subject property was alleged to have been not utilised by the petitioner community people and they have constructed a compound wall around the said land with an intention to encroach the same.
