PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein make the said corrections in respect of the relationship and sex in the said patta in patta no.369 by considering petitioner final representation dated 03.11.2021 within the time limit as fixed by this Hon'ble Court and to file a report in this Hon'ble Court.

The relief sought for in this writ petition is to direct the respondents to make corrections in respect of the relationship in Patta No.369 by considering the petitioner's representation.

2. Consideration of representation by this Court under Article 226 of the Constitution of India, would do no service to the cause of justice. Such corrections are to be made by duly verifying the original records. High Court cannot conduct a Roving enquiry in respect of such disputed issues including the corrections to be made.

3. Thus, the petitioner has to approach the original

authority or the Appellate Authority by filing an appeal under Section 12 of the Patta Passbook Act, 1983 for the redressal of his grievances. When there is an appeal provision, the petitioner has to exhaust the same. The present writ petition has been filed, seeking correction in the patta granted by the original authority and thus, the petitioner has to approach the competent authority or the Appellant Authority for the redressal of his grievances.

4. With this liberty, the writ petition stands disposed of. However, there shall be no order as to costs.
