Order : This Miscellaneous petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.J.POTHIRAJ, Advocate for the petitioner and Respondent not appearing either in person or by an Advocate for the 5th Respondent, the court made the following order:-
The writ petitioner is an Agriculturist. He was enjoying electricity connection for the petition mentioned land and the same was disconnected by the 5th respondent / TANGEDCO. Seeking restoration of the electricity connection, this Writ Miscellaneous Petition came to be filed.
2.The learned Standing Counsel appearing for TANGEDCO was informed about the listing of the case, but there is no appearance on behalf of TANGEDCO.
3.The learned counsel for the petitioner draws my attention to the orders passed by this Court in W.P.Nos.12196 of 2022 and 12245 of 2022 dated 06.05.2022. The case on hand is quite similar. The petitioner gives an undertaking through his counsel that the water drawn by him from the well, will not be put to any commercial use.
4.Recording the said undertaking, the Writ Miscellaneous Petition stands allowed and the 5th respondent / TANGEDCO is directed to restore the respective electricity connection forthwith without any delay.
