This Second Appeal coming on for hearing on this day upon perusing the Grounds of Appeal and the judgments and decrees of the Lower Appellate Court and the material papers in the Suit and upon hearing the arguments of Mr. R.A.MOHANRAM, Advocate for the Appellant,Mr.A.HAJA MOHIDEEN, Advocate for Respondents No. 1 to 3, Mr.M.VENKATESAN advocate for the 7th respondent and none appeared for Respondents No. 4 to 6 and 8 to 10 and this court while Dismissing this Second Appeal, this Court doth order and decree as follows:-
(1) That the judgment and decree, dated 03.03.2009, passed in A.S.NO.16 of 2007 on the file of the Subordinate Judge, Uthamapalayam confirming the Judgment and Decree, dated 11.09.2006, passed in O.S.NO.253 of 2005, on the file of the District Munsif, Uthamapalayam be and hereby is confirmed and the Second Appeal is dismissed; and ;
