This application is presented by the auction purchaser. The applicant had participated in the auction sale conducted on 11.01.2022. Upon being declared as the highest bidder, the applicant was directed to pay the entire sale consideration of about Rs.2.20 crore in respect of the immovable property of the extent of 173.40 acres. Upon payment of the entire sale consideration, the sale was confirmed in favour of the applicant. Pursuant thereto, a sale certificate was executed in favour of the applicant on 26.05.2022.

The applicant states that the Sub Registrar, Srivaikundam refused to receive and register the sale certificate on the ground that the lands comprised in Survey Nos.31/2, 34, 35 and 36/1 of Vallakulam Village, Srivaikundam Taluk, are the subject matter of land ceiling proceedings. Therefore, the applicant seeks issuance of a modified sale certificate by deleting the lands covered by about five survey numbers and aggregating to the extent of 28.35 acres.

Learned Administrator confirms that land ceiling proceedings were

initiated in respect of the above mentioned extent of 28.35 acres. Learned Administrator states that C.A.Nos.1454 to 1457 of 2010 were filed and are pending adjudication as regards the extent of 28.35 acres, which were allegedly purchased by a company called M/s.+Riverway Agro Products Private Limited. Therefore, it is stated that the said extents may be excluded for the present from the revised sale certificate and the matter may be dealt with when the said applications are taken up for hearing.

In the above facts and circumstances, the applicant is entitled to the

relief prayed for. Consequently, the Official Liquidator is directed to issue a modified sale certificate by deleting the following Survey Numbers and the extents specified below from such revised sale certificate:
