Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to stay the operation of the judgment and decree dated 30/11/2009 in OS.No.145/1992 on the file of Principal Sub-Court, Tirunelveli and the judgment and decree dated 22/06/2016 in AS.No.20/2015 on the file of the Principal District Judge, Tirunelveli.
PRAYER IN S.A.(MD) No.174 of 2017 :
To prefer this Memorandum of Grounds of Second Appeal against the Judgment and Decree of the Principal District Judge, Tirunelveli dated 22.06.2016 in A.S.No.20/2015 in and by which the judgment and decree passed by the Principal Sub Judge, Tirunelveli dated 30.11.2009 passed O.S.No.145/1992 came to be confirmed.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.I.ABRAR MD ABDULLAH, Advocate for the petitioner, the court made the following order:-
The appeal is right for argument. Hence there is no use in keeping the said petition pending any further.
Accordingly CMP(MD) No.3099/2017 in SA(MD) No.174/2017 is closed.
