The above miscellaneous petition itself is filed to restore the Second Appeal which was dismissed for default on 10.03.2017.
2.When the matter was listed on 09.02.2022, there was no appearance on behalf of the petitioner. However, to give one more opportunity to the petitioner, this Court directed the Registry to post the matter today under the caption ''For Dismissal''.

4.Hence, this Court is left with no other option except to dismiss this petition.
5.In the result, this Civil Miscellaneous Petition is dismissed for non prosecution.
