The first defendant in the suit has presented this application to condone the delay of 150 days in filing the written statement. On instructions, learned counsel for the plaintiff states that he has no objection to this application being allowed.
- Upon examining the affidavit in support and being satisfied that sufficient cause is shown, this application is allowed. Consequently, the Registry is directed to receive the written statement of the first defendant. The parties are directed to undertake inspection, admission / denial and file draft issues at the next hearing date.
