An agreement of sale was entered into within the jurisdiction of this Court and advance was also transferred, pursuant to such agreement, within the jurisdiction of this Court. It is stated by Mr.T.N.Rajagopal, learned counsel for the applicant/plaintiff that specific performance is not sought to be enforced, but the return of the advance amount is sought. The 4th respondent / 4th defendant is residing outside the jurisdiction of this Court. Leave is sought. Leave is granted. This application is allowed. The Registry may proceed to number the suit, if it is otherwise in order.
