C.V.KARTHIKEYAN,J.
On 22.08.2022, my learned predecessor after examining the records noted as follows:
“3.Since none appeared on behalf of the defendants,
viz., 1, 3 to 7 and 9 to 12 and no written statement has been
filed on their behalf, the defendants 1, 3 to 7 and 9 to 12
are set ex-parte.”
2.Effectively, the defendants 3 to 7 and 9 to 12 and also the 1st
defendant had been set ex-parte in the suit. This application has been filed by the defendants 3 to 7 and 9 to 12. Since they had been set ex-parte in the suit, this application does not survive and the same is dismissed. If at all the order against the said defendants are set aside at any point of time, they are at liberty to file a fresh application, if at all the cause survives.
