PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents herein to consider the representation of the petitioner dated 27.01.2021 and to grant natham patta to the petitioner for the property in Old S.No.103/7 corresponding to new S.No.260/4 of an extent of 3 cents in Kandadevi Village, Devakkottai Taluk, Sivaganga District.

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the respondents to consider the representation made by the petitioner on 27.01.2021, wherein the petitioner is seeking for patta with respect to the subject property.

The learned Additional Government Pleader appearing on behalf of the respondents submitted that the application given by the petitioner is opposed by one Arasappan, who is also claiming right over the property. The learned Additional Government Pleader further submitted that an enquiry will be conducted by giving an opportunity to both the parties and a decision will be taken, within the time fixed by this Court.

Taking into consideration the facts and circumstances of the case and also of the fact that the fourth respondent has already entertained the application submitted by the petitioner, there shall be a direction to the fourth respondent to conduct an enquiry, after affording sufficient opportunity to the petitioner and the above said Arasappan and pass orders on its own merits and strictly, in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

The petitioner is directed to make a fresh representation to the fourth respondent along with all the relevant documents and also a copy of this order.

This Writ Petition is disposed of with the above direction. No costs.
