This peition under Article 226 of Constitution of India to issue a Writ of certiorarified Mandamus to call for the records on the file of the 2nd respondent in pursuant to the impugned order passed by him in his proceedings No.nil dt. 27.07.2021 and quash the same as illegal and arbitrary and consequently diret the respondents to conduct physical measurement test (chest) to the petitioner afresh by a qualified Physical Director within the time limit that may be stipulated by his Honble Court.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.R.S.P.Naveen Kumar, Advocate for the Petitioner and of Thiru.Veera Kathiran, Additional Advocate General,Assisted by Mr. A.K.Manickam, Standing Counsel for state for the respondents, this Court made the following order:
The learned Additional Advocate General has filed a Report https://hcservices.ecourts.gov.in/hcservices/ submitted by the 2nd respondent, wherein, it is stated that pursuant to the directions of this Court, the petitioner was called for to appear before the Sub Committee for chest re-measurement test on
26.10.2021 and the petitioner was re-measured wherein, the petitioner had chest measurement of 81 cms in normal state and 89 cms on expanssion and thereby, he is qualifed in Physical Measurement Test.
2.The learned Additional Advocate General would also submit that since the petitioner has qualified in Physical Measurement Test, he will be considered and subjected to further selection process as per the Recuritment Notification.
3.Recording the statement made by the learned Additional Advocate General, the Writ Petition stands closed and the respondent/Recruitment Board is directed to proceed further in respet of selection of the petitioner as per the selection process notified in the Recruitment Notification.
