Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent in Final Order No.8/2008-C.Ex dated 28.02.2008 and quash the same and send back the case to the Central Excise Officer having jurisdiction for adjudication in accordance with the provisions of the Central Excise Act, 1944.
ORDER
The learned standing counsel for the petitioner informs the Court that the petitioner does not want pursue the writ petition and he seeks permission of this Court to withdraw the writ petition.
2.Permission is granted. The writ petition is dismissed as withdrawn. No costs.
