The learned counsel appearing for the petitioner, on instructions, would submit that, since the very challenge made in this Writ Petition is related to a defence statement memo, however the very main charge memo itself, which was under challenge in W.P. No. 26108 of 2003, was quashed by this Court. Hence nothing survives in the challenge made in the present Writ Petition. Therefore, recording the same, the learned counsel wants this matter to be dismissed as infructuous.
