was purchased in the name of the mother of the petitioner in Survey Nos.389/2, 388/3, 388/7 and 389/7 in Keeranur Village, Ulundurpet. While being so, the father of the petitioner died intestate leaving the petitioner and other legal heirs. the petitioner's mother is entitled for 1/8th share and other legal heirs including the petitioner herein are entitled to the remaining 7/8 shares. After the demise of the father of the petitioner, the mother of the petitioner claiming the aforesaid property as she is absolute owner of the property alienated the same in favour of petitioner's brother and refused to come forward for partition of property. Under such circumstances, the petitioner has sent a protest petition to the 2nd respondent on 22.11.2016 and the same was taken on file by the 2nd respondent as 75 of 2016. Thereafter, the petitioner has filed a suit for partition in O.S. No.500 of 2016 on the file of the Additional Sub-Court-II and subsequently transferred on the file of the Sub-Court, Ulundurpet in O.S. No.97 of 2017. Thereafter, a petition for interim injunction was also filed in I.A. No.242 of 2017 seeking to restrain the defendants from alienating the property and creating further encumbrances in the suit property and the same was allowed by order dated 08.11.2017. However, the mother of the petitioner has been continuously taking steps to alienate the said property. The petitioner again gave a protest petition on 09.03.2021 to the 2nd respondent herein not to make any registration and create further encumbrance with respect of the property situated in Survey Nos.389/2, 388/3, 388/4 and 389/7 and the same was taken on file by the 2nd respondent as 15 of 2021.
