Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus forbearing the first respondent bank from introducing implementing or in any other manner enforcing any amendment to Regulation 5 of the Indian Overseas Bank Officers Service Regulations pursuant to the Communication bearing No. 1.1/1/1/99 IR dated 10.05.2006 issued by the second respondent.
The impugned order is dated 10.05.2006 issued by the Government of India, Ministry of Finance (Department of Economic Affairs), Banking Division sent to the Senior Vice President, Indian Banks' Association, Mumbai, whereby the Central Government has forwarded the model notification containing amendment to Regulation 5 of Officers' Service Regulations as approved by the Honourable Minister of States (FB&I) and vetted by the Ministry of Law. It was further stated in the impugned communication that the said notification may be forwarded or circulated to all the banks so as to enable them to get the amendment notified.
