When the matter is taken up for hearing Mr.K.V.Shanmuganathan, learned counsel appearing for the petitioner submitted that he could not trace the workman and that he has not received any instructions from his client.

In view of the above submissions made by the learned counsel for the petitioner the writ petition is dismissed for non prosecution. However, in case the petitioner or his legalheirs enter appearance, the matter will be re-opened and heard on merits and thereafter, suitable orders will be passed. No costs.
