Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents to consider representation dated 11.04.2018 and pass orders by granting patta for an extent of 1865 ½ sq.ft. Comprised in S.No.510/114, Plot No.113, bearing Door No.17, 8^th Cross Street, New Colony, Pallavaram Village, Tambaram Taluk, Kancheepuram District.

The prayer sought for herein is for a Writ of Mandamus to direct the respondents to consider representation dated 11.04.2018 and pass orders by granting patta for an extent of 1865 ½ sq.ft. Comprised in S.No.510/114, Plot No.113, bearing Door No.17, 8^th Cross Street, New Colony, Pallavaram Village, Tambaram Taluk, Kancheepuram District.

The case of the petitioner is that, the petitioner purchased the property situated in Survey No.510/114 bearing Door No.17 in 8^th Cross Street, New Colony, Jamin Pallavaram Village with Old No.125 and New No.90 within the jurisdiction of Pallavaram Municipality. Since she has been in the possession and enjoyment of the property, in order get patta to the said land, the petitioner made a representation dated 11.04.2018. Since the same has not been considered and patta has not been issued, the petitioner has approached this Court with the aforesaid prayer.

Heard Mr.V.Viswanathan, learned counsel appearing for the petitioner, who has reiterated the aforesaid facts and seeks the indulgence of this Court for directing the respondent to dispose of the representation submitted by the petitioner within a time frame.

Heard Mr.N.Inbanathan, learned Additional Government Pleader appearing for the respondents, who would submit that, if at all the petitioner has purchased the land in question for which she seeks patta and for the said purpose if she has given a representation, the same would be considered on merits and in accordance with law and accordingly the needful would be done within a time frame that may be stipulated by this Court.

Considering the said submissions made by the learned counsel appearing for both sides, and by taking into account the innocuous nature of the prayer, this writ petition is disposed of with the following order.

That there shall be a direction to the respondent to consider the representation dated 11.04.2018 with regard to the plea of the petitioner for issuing patta to the land in question, after giving opportunity of being heard and accordingly decide the same and if the petitioner is otherwise eligible to get patta for the land in question, the same shall be issued to the petitioner and the needful as indicated above shall be done within a period of twelve weeks from the date of receipt of a copy of this order.

It is made clear that, if the respondent wants to delegate the job to the Revenue Tahsildar concerned, the representation dated 11.04.2018 along with a copy of this order with his endorsement can be forwarded to the Revenue Tahsildar concerned and on receipt of the same, the said Revenue Tahsildar shall do the needful within the aforesaid time frame.

With these directions, this writ petition is disposed of. No costs.
