The auction cum tender notification issued in March 2015 is under challenge in the present Writ Petition. Further, direction is sought for to direct the 3^rd respondent to issue a fresh auction cum tender notification with respect to the “construction of additional leeward break water and short groynes to mitigate the sea erosion in eastern coastal village of thengapattinam fishing harbour in kanniyakumari district (balance work)”

The learned Government Advocate appearing on behalf of the respondents relied on the counter affidavit and made a submission that the impugned notification was called upon and as per schedule the tender was opened and concluded. The Tender Award Committee accepted the tender and finalised the lowest price and the entire process became final. The present Writ Petition was filed in the year 2015 and by this time, the project itself would have been completed.

In view of the facts and circumstances, the relief sought for in the present Writ Petition lost its relevance and thus no further adjudication is required. If at all any grievances exists, it is left open to the petitioner to approach the competent authoity.

With these observations, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petitions are closed. No costs.
