PRAYER : Appeal filed under Section 100 of Civil Procedure Code, against the Judgment and decree of the Court of the District Judge, Nagapattinam, dated 22.03.2004 in A.S.No.2 of 2004 confirming the Judgment and Decree of the Court of Additional Subordinate Judge, Nagapattinam, dated 02.07.2003 in O.S.No.161 of 2000.

DECREE : These Second Appeal coming on for hearing on Wednesday the Seventeenth day of February 2021 and upon perusing the Grounds of Appeal and the Judgments and Decrees of the Lower Appellate Court and the Court of first instance and the records of the Lower Court and upon hearing the arguments of Mrs.S.Thamizharasi, Advocate on behalfof the Appellant and of Mr.M.S.Palanisamy, Advocate for the Respondent, and having stood over for consideration till this day, this Court, doth order and decree as follows:

1.that the Judgment and Decree made in A.S.2 of 2004 dated 22.03.2004 on the file of District Judge, Nagapattinam, and the Judgment and Decree made in O.S.No.161 of 2000 dated 02.07.2003 on the file of Additional Subordinate Judge, Nagapatinam be and hereby are confirmed and this Second Appeal is dismissed;

2.that there be no costs in this Second Appeal.
