DECREE : This second Appeal coming on for hearing on Wednesday, the 10^th day of March 2021 upon perusing the Grounds of Appeal, the Judgment and Decrees of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mr.Thilak Narayanan for M/s. T.M. Hariharan and of Mr.G.Sankaran, Advocate for the respondent, and having stood over for consideration till this day and this Court doth order and decree as follows:

(i)that the Judgment and Decree of the Additional Subordinate Court, Salem, dated 16.07.2008 made in A.S.No.42/2008 confirming the judgment and decree dated 06.12.2007 made in O.S.No.336/2007 on the file of the first Additional District Munsif Court, Salem be and hereby are confirmed and the second Appeal is dismissed.

(ii)That the Appellant/Plaintiff do pay a sum of Rs.10/-(Rupees ten only) to the respondent/defendant towards the costs incurred in this appeal.
