This application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996 seeking for injunction restraining the respondents from contacting/dealing in any manner with customers of the applicants as specified in the Schedule to this application.

The Notice in this application was duly served on the respondents. By order dated 07.07.2021, this Court after giving due consideration to the merits of the matter, has granted an order of interim injunction as prayed for in OA No.275 of 2021.

After recording the fact that despite service of notice on the respondents, the respondents did not appear. The injunction granted earlier is still in force. Till date, the respondents have not entered appearance.

This Court has also perused the earlier order dated 07.07.2021 passed by this Court and is in agreement with the view taken by this Court earlier.

Since, prima facie case and the balance of convenience is in favour of the applicants, the injunction granted earlier on 07.07.2021 in O.A. No.275 of 2021 is made absolute and O.A. No.275 of 2021 is allowed.

In the earlier order dated 07.07.2021 referred to supra, this Court had granted liberty to the applicants to approach the Arbitral Tribunal under Section 17 of the Arbitration and Conciliation Act, 1996 with regard to the relief sought for in A. Nos.2139, 2140 and 2141 of 2021. The liberty granted earlier shall continue.
