PRAYER:- This Petition is filed under Section 115 of the Code of Civil Procedure, to set aside the fair and decreetal order passed in R.C.A.No.49 of 2019 in R.C.O.P.No.52 of 2016 on the file of the Rent Control Appellate Authority (Principal Subordinate Judge), Madurai dated 10.03.2021 and by confirming the fair and decreetal order passed in RCOP.No.52 of 2016 on the file of the Principal Rent Controller Madurai Town (Principal District Munsif, Madurai Town) dated 21.01.2019.

Pursuant to the orders of this Court dated 19.11.2021, an affidavit of undertaking has been filed by the 1^st petitioner, Kanagalingam for himself and on behalf of the petitioners 2 and 3, who are his brothers. A statement to this effect has been averred to in paragraph No.1 of the affidavit of undertaking. The petitioners have undertaken to vacate the suit schedule property within a period of 3 months from the date of receipt of a copy of the order. It is needless to state that till the possession is handed over, the petitioners shall pay the monthly rent without fail on or before the 5^th of every succeeding English Calendar Month.
