PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No. 10 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :-

The petitioner/Accused, who was arrested and remanded to judicial custody on 28.09.2021 for the offence punishable under Sections 417, 420 IPC and Section 4, 6 of Prize Chit & Money CIR, Schemes (Banning) Act, 1978, in Crime No.10 of 2021, on the file respondent police, seeks bail.

This Court, on considering the affidavit filed by the petitioner undertaking to pay a sum of Rs.10,00,000/- within the time fixed by this Court and also to repay the entire amount, due to the other persons within a period of three months, has granted interim bail for a period of four weeks and also appointed an Advocate Commissioner for settling the issues and this Court has also issued several directions, vide order dated 01.10.2021

Today (22.11.2021), when the matter is taken up for hearing, the learned counsel for the petitioner would submit that the petitioner has not complied with the order passed by this Court on https://hcservices.ecourts.gov.in/hcservices/ 01.10.2021. He would further submit that the petitioner has not even

chosen to pay the remuneration amount fixed by this Court to the Commissioner and that she has not complied with the other directions of this Court.

4.The learned Additional Public prosecutor would submit that the petitioner had cheated several persons to the tune of Rs.39,56,692/- and 11 sovereigns of gold jewels.

5.Considering the seriousness and gravity of the offence alleged by the prosecution and also the quantum of amount involved and also taking note of the fact that the petitioner has not complied with the order passed by this Court dated 01.10.2021 in Crl.OP(MD)No.14512 of 2021 and that the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, the Criminal Original Petition is dismissed.
