M.Nehru v. State Rep.by
Case brief
What is this about?
The High Court modified a lower court order in a bail matter, setting aside a condition requiring a cash deposit of Rs.50,000. The court held that since the petitioner had transit permission to carry the mineral, the deposit condition was inappropriate, ruling such onerous conditions should not be insisted upon when prima facie authorized transport is evident.
What did the court decide?
The condition directing the petitioner to deposit a sum of Rs.50,000/- is set aside; other conditions imposed by the lower court stand.
