Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed upon them by this Hon`ble Court that they appear before the Inspector of Police, V.Kalathur Police Station once in a week i.e on every Monday at 10.30am in Crl.M.P.No. 8332 of 2020 dated 21.12.2020 pending disposal of the C.A.No. 229 of 2020.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. V.BALU, Advocate for the petitioner and of MR.R.MUNIYAPPARAJ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondents the court made the following order:-

This petition has been filed to relax the bail condition imposed by this Court vide order dated 21.12.2020 passed in Crl.M.P.No.8332 of 2020 in Crl.A.No.229 of 2020.

This Court, by order dated 02.11.2020 in Crl.M.P.No.6216 of 2020 in Crl.A.No.229 of 2020, granted suspension of sentence and bail to the petitioners on certain conditions, one of which is that the petitioners should stay in Madurai and report before the Thallakulam Police Station, Madurai, everyday at 10.30 a.m. until further orders.

Thereafter, the aforesaid condition was modified by this Court vide order dated 21.12.2020 in Crl.M.P.No.8332 of 2020 in Crl.A.No.229 of 2020 to the effect that the petitioners should report before the Inspector of Police, V.Kalathur Police Station, Perambalur District, once in a week. i.e., on every Monday at 10.30 a.m., until further orders.

For relaxing the aforesaid condition, the petitioners have preferred the present petition.

Heard Mr.V.Balu, learned counsel for the petitioners and Mr.R.Muniyapparaj, learned Additional Public Prosecutor appearing for the respondent/State.

On instructions, the learned Additional Public Prosecutor submitted that the petitioners are complying with the aforesaid condition since 05.04.2021.

In such view of the matter, this criminal miscellaneous petition stands allowed and the aforesaid condition is relaxed and modified as follows:

“The petitioners shall appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if they are not able to appear before the trial Court on any day, they shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of their absence, as directed by the trial Court.”
