who was an Ex-Service Man, had purchased an agricultural nanja land measuring an extent of 2 acres 11 cents from one Alagarsamy Naidu, S/o. Subba Naidu at Kanavaipatti on 27.01.2005 through sale deed. He had approached Thiru.A.Solaimalai, the Village Administrative Officer of Kanavaipatty/Accused in Special Case No.31 of 2014, for measuring the purchased land and for transfer of patta and he had filed a petition for the same. Based on the petition, the Firka Surveyor had proposed to visit the village to measure the property that he had purchased. On 19.03.2005, the Firka Surveyor came to the newly purchased agricultural field and measured the property. The Village Administrative Officer/Accused was also present in the land that was measured. Later on, the accused/Village Administrative Officer obtained a statement from the complainant P.W-2-Rangasamy and he had obtained photostat copies of the sale deed for the property that he purchased. Thereafter, the accused/appellant demanded a sum of Rs.3,000/- for change of patta. P.W-2 was reluctant to pay him. The appellant/accused had informed P.W-2 that only on his recommendation, the Tahsildar will transfer patta. He had approached the accused/appellant on 31.03.2005 regarding transfer of patta for which the accused before the Trial Court/appellant before this Court had insisted that without paying Rs.3,000/- he will not recommend patta transfer. P.W-2 requested him to consider the difficulties of PW-2 and to reduce the amount. For which, the appellant/accused insisted him to pay at least Rs.2,000/- on 01.04.2005 by around 02.00 p.m. Therefore, P.W-2 had preferred a complaint under Ex.P-5 with Vigilance and AntiCorruption Police at Dindigul based on which Mr.Raja Mohammed, Inspector of Police, Vigilance and Anti-Corruption, had registered the FIR under Ex.P-6 in Crime No.3 of 2005 under Section 7 of the Prevention of Corruption Act, 1988. He had sent the original FIR under Ex.P-6 and complaint under Ex.P-5 to the Court of the learned Chief Judicial Magistrate, Dindigul and the copies of the same to the higher officials including the Superintendent of Police, Vigilance and Anti-Corruption, Southern Districts and Deputy Superintendent of Police, Vigilance and Anti-Corruption, Dindigul.
