The Judgment and Decree dated 29.10.2013, passed in
W.C.No.312 of 2007 is under challenge in the present Civil
Miscellaneous Appeal.
2. The substantial question of law raised by the
appellant reads as under:
1) whether the Commissioner is correct in
holding the 1 st respondent as legal heir of the deceased
P.Venkatarao when she being widowed sister of age 60
years.

2)whether the Commissioner is wrong in allowing the claim against the statute in Section 2(1)(d) of Workmen Compensation Act, 1923.

3. All the questions of law raised are relatable to the facts.

4. The appellant is the Southern Railway. The respondent filed an application under the Workmen's Compensation Act seeking compensation due to the death of P.Venkata Rao who is the worker in the Southern Railway. The accident was occurred on 25.12.1996 and the said worker died while he was in service. The Deputy Commissioner of Labour adjudicated the issues with reference to the documents and evidences. The findings in the award reveals that when the deceased/Mr.P.Venkata Rao was working as labour, the accident occurred and due to stress and strain, he sustained heart attack and died. 5. In view of the above findings, this Court is of the opinion that no further adjudication with reference to the facts are required. The substantial questions of law raised in the appeal are also unacceptable as they are relatable to the facts and circumstances. This being the factum, this Court do not find any infirmity as such in respect of the award passed by the Deputy Commissioner of Labour. Accordingly,the award dated 29.10.2013, passed in W.C.No.312 of 2007 stands confirmed and

consequently, the Civil Miscellaneous Appeal stands dismissed. No costs. Connected miscellaneous petition is also closed.

6. The respondents/claimants are permitted to withdraw the award amount with accrued interest by filing an appropriate application and the payments are to be made through RTGS.
