The suit has been filed for partition. There are five items of properties, which are the subject matter of the partition suit. Two of the items of properties, i.e, items 4 and 5 are situated outside the jurisdiction of this Court and the remaining properties viz., items 1 to 3 are situated within the jurisdiction of this Court.
- The plaintiff and the defendants are also residing only within the jurisdiction of this Court. Therefore, this Court is inclined to grant leave as prayed for.
- Accordingly, leave to sue is granted as prayed for and this
application is allowed.
- The Registry is directed to number the suit, if it is otherwise in
order.
