The short point canvased in the application No.3117 of 2020 filed by the 45^th defendant is that the Google India Private Limited as such a subsidiary company of the Google LLC operating and incorporated under the laws of USA, located at 1600 Amphitheatre Parkway, Mountain View, https://hcservices.ecourts.gov.in/hcservices/ California 94043, United States of America.

According to the applicant / the 45^th defendant, it is only a subsidiary company of Google LLC and his line of operation is to monitor the advertisement programme in India and therefore the applicant / the 45^th defendant is neither infringed nor caused the infringement of any copyright to service provider of Internet and does not hold, control or manage any website or to provide any service.

4. In fact in the pleadings of the plaint, there is no specific averments against the applicant / the 45^th defendant to array as one of the defendants. It is also brought to the notice of this Court by the learned counsel appearing for the 45^th defendant that some of the Courts in India have already considered the similar plea in suits filed against the Google India Private Limited and the order of deletion from arraying as parties specifically holding that the suits of this nature Google India Private Limited need not be arrayed as defendants. Only You Tube LLC controls uploading of movies through Google LLC incorporated under the laws of USA.

has held that though Google India Private Limited and Google LLC incorporated at USA may be a separate legal entity, undoubtedly, Google India Private Limited is subsidiary of Google LLC. Therefore, it is necessary to make the subsidiary company person in India as a party to the proceedings.

On considering the rival submissions, the fact whether the uploading of the cinematography film in You Tube and display of the same does not fall within the operation of the 45^th defendant can be decided, only in the course of trial. Now the 45^th defendant has brought to the notice of the plaintiff that operation of You Tube and exhibition of films are controlled and owned by Google LLC incorporation at USA and it is open for the plaintiff to implead the Google LLC, USA, if it is so advised. However, this application is concerned, this Court is of the view that being subsidiary of the holding company and its object of incorporation indicates that it controls business of Internet based advertising, processing, modifying, altering, rectifying and / or correcting all types of data, this Court not able to decisively conclude that the 45^th defendant is an https://hcservices.ecourts.gov.in/hcservices/ unnecessary party to the proceedings.
