Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for a WRIT OF MANDAMUS or any other appropriate Writ Order or Direction in the Nature of a Writ, directing the 1st Respondent to consider the Representation of the Petitioner dated:08.06.2020 on merits after giving the opportunity to the Petitioner herein within a stipulated time frame and consequently direct the Respondents herein to maintain the status quo till the disposal of the Petitioner’s Representation dated:08.06.2020 in R.S.No:3/1 of Agasthiyampalli Village, Vedaranyam Taluk, Nagapattinam District.

By consent, this writ petition is taken up for final disposal at the time of admission itself, through Video Conferencing.

2.According to the petitioner, he is the absolute owner of the property situated in R.S.No.3/1 of Agasthiyampalli Village, Vedaranyam Taluk, Nagapattinam District. On 01.06.2020, without any notice, the officials of the respondents 2 and 3 entered into his property and started to erect a new 110 kv transmission line. On enquiry, the petitioner came to know that out of 99 towers, 95 were erected in the previous 33 kv Transmission route and 4 towers are to be erected in the locations, much nearer to the said residential area. As the said project is planned ignoring the tower falling distance and any future damage to the power transmission lines and uprooting of towers due to cyclones, would cause loss to the life and property of the surrounding people, the petitioner submitted a representation dated 05.06.2020 raising objection to the said project and the same is pending without any consideration. Hence, the petitioner has approached this Court with the present writ petition for appropriate relief.

3.Mr.Abdul Saleem, learned Standing Counsel taking notice for the respondents 2 and 3, on instructions, submitted that enquiry is scheduled to be held on 01.07.2020 and the petitioner is also participating in the same.

4.Recording the aforesaid submission made by the learned Standing Counsel for the respondents 2 and 3, this Court directs the respondents to go on the enquiry as scheduled and decide the matter, in the manner known to law.

5.Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
