PRAYER:- Writ petition filed under Article 226 of the
Constitution of India prays to issue a Writ of mandamus
directing the respondents to remove the garbage bins placed at
the entrance of the hospital, immediately so as to keep hospital
surroundings clean and hygienic and also to benefit the
pedestrians as well as the vehicles passing through the road
outside the hospital.

(1)By consent, the writ petition is taken up for final disposal. Mr.Akhil Akbar Ali, learned Government Advocate accepts notice on behalf of the 2^nd respondent and Mr.K.Soundararajan, learned Standing counsel accepts notice on behalf of the 3^rd respondent.

(2)The writ petition is styled as a public interest litigation filed by a resident of Royapettah, Chennai-14 and the learned counsel for the petitioner has invited the attention of this Court to page No.3 of the typed set of documents and would submit that right in front of the Children's Hospital as well as the campus of the said hospital located on the opposite side at Egmore, Chennai-8, three overflowing garbage bins are found and the garbage bins are leaking and leading to insanitary and health hazard conditions outside the Children's Hospital and in this regard, the petitioner has also submitted a representation dated 25.11.2019 and it has failed to invoke any kind of response. Therefore, the learned counsel for the petitioner prays for appropriate orders.

(3)Mr.K.Soundararajan, learned Standing counsel appearing for the 3^rd respondent would submit that good quality garbage bins would be replaced and regular clearance of the same, would be done.

(4)When this Court has put a specific query as to the sanitary conditions inside the Institute of Child Health and Hospital for Children, Mr.Akhil Akbar Ali, learned Government Advocate appearing for the 2^nd respondent undertakes to file a Status Report.

(5)This Court has considered the rival submissions and also perused the materials placed before it.

(6)This Court, taking into consideration, the above facts and circumstances, directs the 3^rd respondent to replace the garbage bins with good quality garbage bins and clean / clear it at regular intervals and also maintain sanitary conditions in and around the hospital, in a neat and tidy manner.

(7)The 2^nd respondent is also directed to maintain hygienic and sanitary condition inside the hospital for the reason that the children of the family of lower strata of the society / economically backward, are getting treated and therefore, it is

their duty to maintain healthy and sanitary condition inside the hospital also.

(8)The respondents 2 and 3 are directed to file Status Reports with supporting documents and photographs as to the directions passed by this Court in this writ petition.

(9)The writ petition stands disposed of accordingly. No costs.

(10) Call the matter on 27.02.2020 for filing of the status reports of the respondents 2 and 3 with supporting documents and photographs.
