(i) It is true that the defendants 1 and 2, through a registered sale deed dated 24.09.1998, have purchased the suit property from the defendants 3, 5 and others and that the relationship averred by the plaintiff is correct. Since the plaintiff wanted to purchase the suit properties and one Sellappa Nadar was alleged to have a pathway along and across the suit property, having anticipated a prolonged and agonizing Court proceedings, the 1st defendant has decided to sell the suit properties to the plaintiff and that at that time, the plaintiff did not have enough cash and even though the sale price was fixed at Rs.3,17,000/-, the plaintiff was able to mobilize only Rs.1,17,000/- and that on 15.07.2002, he paid Rs.1,17,000/- alone, as part of the sale consideration and he promised to pay the balance of Rs.2,00,000/- soon after the anticipated litigation with Sellappa Nadar, came to an end.
